Federal Judge Overturns New York’s Stun Gun Ban

Yesterday, a Federal Judge ruled that it is unconstitutional for New York to ban people from owning stun guns since the ban is in violation of the second amendment. The ruling was given by U.S. District Judge David Hurd.

The judge said, “New York’s sweeping prohibition on the possession and use of tasers and stun guns by all citizens for all purposes, even for self-defense in one’s own home, must be declared unconstitutional.”

The case was brought to the Judge by Matthew Avitabile, who sued the New York police superintendent when he could not buy a stun gun to defend himself in upstate New York.

New York has some of the strictest gun laws in the country. It’s nice to see a federal Judge upholding the constitution even in a neo-liberal state like New York.
